Although Water is a State subject, the regulation of ground water abstraction is being done at both Central and State levels. At the central level, Central Ground Water Authority (CGWA) constituted in January 1997 under sub-section (3) of Section 3 of the Environment Protection Act 1986 as per direction of Hon’ble Supreme Court of India, has been vested with responsibility for regulation and control of groundwater development and management. Central Ground Water Authority(CGWA) is a statutory body of India under Section 3 of the Environmental (Protection) Act 1986, for regulating groundwater abstraction, its usage, and monitoring. The authority functions by issuing No Objection Certificates.
CGWA has issued Guidelines from time to time for evaluation of proposals/requests for ground water abstraction with the objective of ensuring sustainability of ground water both in terms of quantity and quality, looking into the variations in availability of water in different climatic regions and diverse hydro-geological conditions in various States of the country including Rajasthan.
CGWA regulates ground water development and management by issuing ‘No Objection Certificates’ (NOC) for ground water extraction to industries or infrastructure projects or Mining Projects etc. Necessary conditions for implementation by the proponent are laid down in the CGWA NOC in Rajasthan issued by the authority.
No objection certificate from central ground water authority is a legal permission to abstract underground water from borewell and open wells. As per CGWA New Guidelines 2020 (updated for 2026), all new and existing industries, infrastructure projects and mining projects abstracting groundwater will be required to obtain CGWA NOC in Rajasthan.

The Assessment Units are the Blocks/Mandals/Taluks/Firkas etc. which are considered as units for ground water resources assessment. In Rajasthan, many blocks have been classified under semi-critical, critical or over-exploited zones based on long-term groundwater data.

All industries in Rajasthan must calculate abstraction charges as per CGWA guidelines based on the groundwater zone classification. Ground water abstraction charges are charges to be paid for abstraction of ground water while applying for CGWA NOC in Rajasthan.
Ground water charges differ on basis of quantum of total water abstracted and type of assessment unit an industry , infrastructure project falls into.
All industries/mining/ infrastructure projects drawing ground water in safe, semi-critical and critical assessment units will have to pay ground water abstraction charges based on quantum of ground water extraction and category of assessment unit as per CGWA guidelines. This is especially relevant in high-use industrial areas of Rajasthan.
Eligible industries in Rajasthan with recharge structures may also apply for the 50% rebate. Existing industries, infrastructure units and mining projects which have installed/constructed artificial recharge structures in compliance of the conditions prescribed in the groundwater guidelines prevailing at the time of grant of No Objection Certificate or its renewal shall be eligible for a rebate of 50% (fifty percent) in the ground water abstraction charges/ground water restoration charges, subject to their satisfactory performance and verification.

Extraction of ground water for commercial use by industries, infrastructure units and mining projects without a valid No Objection Certificate from appropriate authority shall be considered illegal and such entities shall be liable to pay Environmental Compensation for the quantum of ground water so extracted.

Digital Water Flow meters is a device used to measure the flow rate of water or steam flowing through a pipe.
Digital flow meter is connected at the delivery pipe of borewell to determine flow rate of water and total water abstracted from a borewell.
The telemetry system installed along with digital water flow meter has Data Management Software capable of running on a standard PC.
Data Collection Unit or telemetry system is capable of taking data from meter, pump etc. and posting in Data Management Software.
Telemetry system will ensures water meter real time data which is quantum of withdrawal of groundwater can be accessed by CGWA. This system is monitored by CGWA officials across regions in Rajasthan.

Industrial / Infrastructural / Mining Projects/ Government Water Supply Agencies in Urban Areas which are either existing, new or are under expansion and requiring to withdraw ground water have to obtain CGWA NOC in Rajasthan.

One year advance Payment is to be made online through link given in NOCAP Bharatkosh (website: Bharatkosh.gov.in) before submission of application Arrears/ EC/ Penalty, if applicable will be communicated later on approval of application and will have to deposited against the application within stipulated period by logging in into one’s account.
Ground water abstraction charges are amount to be paid against ground water withdrawal based on type of water use, the quantum of ground water extraction and category of assessment unit. All residential apartments/ group housing societies/ Government water supply agencies in urban areas / Industries / Mining/ Infrastructure projects drawing ground water in safe, semi-critical and critical assessment units will have to pay ground water abstraction charges.
All existing Mining / Infrastructure projects / Industries (including MSMEs) and new MSMEs (other than PDWs), new infrastructure (falling in 7 categories in Ans- 7) and new mining projects drawing ground water in over-exploited assessment units will have to pay ground water restoration charges based on their quantum of ground water extraction.
The projects which are abstracting saline groundwater are exempted from paying groundwater abstraction charges. However, in case of delay in submission of application, EC will be charged at the rates prescribed for Safe Area.
Only new industries falling under MSME (other than PDWs) can apply for NOC for ground water abstraction in OE assessment units. New industries falling in other categories can obtain NOC only for drinking/domestic use for work force and greenbelt development. Further New mining Projects and New Infrastructure Projects can apply for NOC in OE areas.
Expansion of existing industries involving increase in quantum of ground water withdrawal falling under Over-exploited assessment units is permitted only for MSME sector.
All industrial projects extracting / proposing to extract ground water in excess of 100 m3/day and up to 500 m3/day ground water in over-exploited, critical and semi-critical areas shall have to mandatorily submit Impact Assessment Report with Analytical Modelling Report.
For GW Extraction above 500 KLD in OCS blocks shall have to mandatorily submit Impact Assessment Report with Mathematical Modelling Report Also in safe areas underlain by hard rock, industries drawing >500 m3/day and in safe areas underlain by alluvium/ soft rock, industries drawing >2000 m3/day are required to submit impact assessment report with Mathematical Modelling.
Yes, but the project proponent shall be liable to pay environmental compensation for the period starting from the date of expiry of NOC, till NOC is renewed by the competent authority.
Yes, extension of NOC will be allowed in case proponent is unable to construct well(s) during the validity period of NOC.
New industry and expansion of existing industries except those falling under MSME category (other than PDWs) located in over-exploited assessment units involving increase in quantum of ground water shall not be granted NOC.
Proponent will have to apply for extension of NOC with valid reason along with supportive documents. Other conditions will remain the same as that for fresh NOC. Extension of NOC will be granted for the maximum period of 2 years.
If the applicant fails to deposit required charges abstraction/restoration charges within the prescribed time limit, the application shall be liable to rejection (even after approval).
Installation of Sewage Treatment Plants (STPs) shall be mandatory for all new residential apartments/ Group Housing Societies where ground water requirement is more than 20 m3/day.
Projects falling within the 500 m. periphery of demarcated wetland area shall mandatorily need to submit consent/approval from the appropriate wetland authorities/ State Authority/ or any other appropriate local government authority to establish their projects in the area.
